Terms of Service

Welcome to WanderKit. These Terms of Service (“Terms”) govern your access to and use of the WanderKit application, website, and related services (collectively, the “Service”) provided by WanderKit (“we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with these Terms and all applicable laws

2. Description of Service

WanderKit is a travel planning application that allows you to:

  • Create and organize trip itineraries
  • Plan and manage travel activities
  • Track expenses and manage budgets (Premium)
  • Create packing lists (Premium)
  • Collaborate with others on trip planning (Premium)
  • Generate AI-assisted trip suggestions

The Service is designed for personal travel planning and is not a booking engine, travel agency, or financial service.

3. Account Registration

Account Creation

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account

Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at wanderkit@symph.co if you suspect unauthorized access.

4. Subscription and Payments

Free and Premium Tiers

WanderKit offers both free and paid features. Premium features require an active subscription.

Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payments are processed through third-party payment providers
  • Prices are subject to change with reasonable notice

Cancellation

  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • We do not provide refunds for partial billing periods

5. User Content

Your Content

“User Content” includes all trip data, itineraries, activities, notes, and other information you create. You retain ownership of your User Content.

Content Responsibility

You are solely responsible for your User Content. You represent that:

  • You have all necessary rights to your content
  • Your content does not violate any third-party rights
  • Your content does not contain illegal or harmful material

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Violate any applicable laws or regulations
  • Upload malicious code or harmful content
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Scrape or automatically extract data
  • Harass, abuse, or harm other users

Violation may result in immediate account termination.

7. AI Features

The AI drafting feature provides suggestions based on your inputs. These suggestions are:

  • Generated by artificial intelligence and may not be accurate
  • Not professional travel advice
  • Subject to availability limitations

Your Responsibility

Always verify important details (opening hours, visa requirements, safety conditions) through official sources before relying on AI-generated suggestions.

8. Third-Party Services

The Service may integrate with third-party services (e.g., Google Maps). Your use of these services is subject to their respective terms and privacy policies. Inclusion of any integration does not imply endorsement.

9. Intellectual Property

The Service, including its design, features, code, and branding, is owned by WanderKit and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our written consent.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Disclaimers

“As Is” Basis

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.

No Travel Advice

WanderKit is a planning tool, not a travel advisory service. We do not provide professional travel advice, guarantees about destinations, or visa/health/safety recommendations. Always consult official sources.

Availability

We do not guarantee that the Service will be available at all times, uninterrupted, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, WanderKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

13. Dispute Resolution

Informal Resolution: Before filing any formal dispute, contact us at wanderkit@symph.co to attempt informal resolution.

Governing Law: These Terms are governed by the laws of the Republic of the Philippines.

Jurisdiction: Any disputes shall be subject to the exclusive jurisdiction of the courts located in the Philippines.

14. Beta Features

We may offer beta or experimental features. These are provided “as is” without warranty and may be modified or discontinued at any time.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms and updating the “Last Updated” date. Your continued use after changes constitutes acceptance.
